Terms of Service

1. The Deal

WalkAura is a mobile role-playing game in which walking in the real world advances your character. By creating a WalkAura account, you agree to these Terms of Service. Our Privacy Policy explains how we process personal data. Where processing requires your consent — including access to step data — we ask for that consent separately, in the app.

2. Your Account

You need an account (username + password, or Google Sign-In) to play. WalkAura is not offered to persons under the age of 16 in the European Economic Area. In other countries, you must be at least 13 and meet any higher minimum age required by local law. Users who have not reached the age of legal majority must have permission from a parent or legal guardian where applicable law requires it.

You must take reasonable steps to protect your credentials and must promptly notify us if you suspect unauthorised access. You are responsible for activity that you authorise or cause and for losses resulting from your intentional or negligent failure to protect your credentials. You are not responsible for unauthorised activity that was not caused by your breach of these obligations.

3. Fair Play

The whole game is walking. So the one cardinal rule: don't fake steps. Prohibited:

• Fabricating, replaying or manipulating step data, or using tools/devices to simulate walking
• Exploiting bugs for advantage instead of reporting them
• Automating play (bots, scripts) or interfering with the service, its servers or other players
• Circumventing technical protections in order to cheat
• Abusive, unlawful or infringing conduct toward other players or the service

Our servers validate step data and reject implausible submissions.

Enforcement. We may reject affected data, correct improperly obtained progression, or temporarily restrict an account where we reasonably believe these Terms have been violated. Except in urgent security or legal cases, serious fraud, deliberate attacks, or severe abuse, we will provide the reason and a reasonable opportunity to stop or correct the violation before permanently terminating an account. Measures will be proportionate to the nature, seriousness, frequency and impact of the violation. You may appeal a rejected submission, correction, suspension or termination by contacting support@walkaura.app within one month.

Automated test accounts operated by or for the WalkAura team (load testing, balance validation) are authorized automation and are not subject to the anti-bot rule. They are operated on separate test environments and their results are not presented as ordinary player results.

4. Licence, Intellectual Property & Virtual Items

Subject to these Terms, WalkAura grants you a personal, limited, non-exclusive, non-transferable and non-sublicensable licence to install and use the app for private, non-commercial gameplay.

WalkAura, its software, art, text, audio, game systems, characters, trademarks and other content are owned by WalkAura's operator or its licensors. No ownership rights are transferred to you. You may not copy, distribute, sell, commercially exploit, modify or reverse-engineer the service except where these activities are expressly permitted by mandatory law. Statutory rights relating to software interoperability, security research and other non-waivable uses remain unaffected.

Gold, items, levels and everything else in the game are fictional, represent limited access to game functionality, have no monetary value, are not redeemable, and are not property, money or financial instruments. During pre-release testing (alpha/beta) we may rebalance, modify or wipe progression as development requires.

5. Health & Safety Notice

WalkAura is a game, not a medical device. It does not diagnose, treat, cure, or prevent any medical condition. Step counts may be incomplete or inaccurate and must not be used to make medical decisions. Consult a qualified healthcare professional for medical advice, diagnosis, or treatment.

Walking and personal safety. You are responsible for choosing where, when and how to walk. Remain aware of traffic, weather, terrain and your surroundings. Do not trespass, enter unsafe or restricted areas, use WalkAura while driving, or interact with the app where doing so would be unsafe or unlawful. Stop activity if you experience pain, dizziness, breathing difficulty or other concerning symptoms. WalkAura does not provide route guidance, emergency monitoring, medical advice, or guaranteed step accuracy.

6. The Service & Changes to It

The game is free of charge and provided during a testing phase: outages, bugs, data loss and breaking changes can happen.

We may change the service for legal, security, technical, compatibility, fraud-prevention, balancing or operational reasons. Ordinary gameplay balancing, bug fixes and security updates may take effect immediately. Where a change materially removes core functionality or materially disadvantages users, we will normally provide at least 30 days' advance notice and explain the reason; users may stop using the service and delete or export their account data before the change takes effect. Immediate material changes may be made where required by law, urgently necessary to protect users or the service, or necessary to address a serious security or integrity risk.

If WalkAura is permanently discontinued, we will provide reasonable advance notice where practicable and an opportunity to request an export before account data is deleted.

7. Liability

Nothing in these Terms limits or excludes our liability:

• for intent or gross negligence;
• for injury to life, body or health caused by a negligent breach of duty;
• under the German Product Liability Act;
• under an expressly given guarantee; or
• in any other case where liability cannot lawfully be limited.

In cases of slight negligence, we are liable only for breach of an essential contractual obligation — that is, an obligation whose performance is necessary for proper provision of the service and on which users may ordinarily rely. In such cases, liability is limited to loss that was foreseeable and typical for this type of contract.

Otherwise, liability is excluded to the extent permitted by law. These limitations also apply to our legal representatives, employees and agents. Mandatory consumer rights remain unaffected.

8. Ending Things

You can stop playing and delete your account at any time (Settings → Delete account, or the web deletion page). We may restrict or terminate accounts as described in Section 3.

9. Changes to These Terms

We may update these Terms to reflect changes in law, security requirements, technical operation, service functionality, or to correct unclear provisions. We will notify you at least 30 days before materially adverse changes take effect unless an urgent legal or security reason requires a shorter period. Changes do not apply retroactively. Where applicable law requires express agreement, we will ask you to accept the revised Terms; otherwise, the revised Terms apply from the stated effective date, subject to mandatory law. You may stop using WalkAura and delete your account before the effective date.

10. Governing Law & Contact

These Terms are governed by German law, excluding the United Nations Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice does not deprive you of mandatory protections provided by the law of the country in which you habitually reside. Statutory rules concerning jurisdiction apply.
